Welcome to CANBOSENG (“CANBOSENG”, “we”, “us”, or “our”). These Terms of Service (the “Terms”) govern your access to and use of canboseng.ca (the “Site”) and any products, services, mobile applications, or features we provide (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use the Services.

1) Who we are

CANBOSENG operates the Site to offer online shopping for goods and related services in Canada and other regions as listed on the Site. If you have questions, see Section 25 (Contact us).

2) Eligibility & account registration

You must be the age of majority in your province/territory/state (or have parental/guardian consent) to use the Services.

You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activities under your account.

We may refuse, suspend, or terminate accounts at our discretion (see Section 20).

3) Products, availability & accuracy

Products, services, descriptions, images, specifications, and prices are subject to change without notice. We try to display colors and details accurately but cannot guarantee your device’s display.

We may limit quantities, reject orders, discontinue products, or restrict sales to any person or region where appropriate.

Packaging may vary from images shown; measurements and weights are approximate unless otherwise stated.

4) Pricing, taxes & currency

Prices are shown in [CAD unless stated otherwise] and exclude applicable taxes, fees, duties, and shipping unless stated.

You are responsible for all applicable taxes, customs, and duties. The final amount, including taxes and shipping, will be shown at checkout where available.

Despite our efforts, items may be mispriced. If we discover a pricing error, we may cancel or adjust the order and will contact you with options.

5) Orders, acceptance & cancellations

Your order is an offer to buy. We accept your offer only when we send an order confirmation or ship the product.

We may cancel or refuse any order (e.g., suspected fraud, errors, limited stock, shipping restrictions). If we cancel, we will refund any amount charged for unshipped items.

You may request order changes/cancellations before shipment by contacting us; approval is not guaranteed.

6) Payment & billing

We use third‑party payment processors (e.g., Stripe, PayPal). By submitting a payment, you authorize the charge to your selected method.

We do not store full card numbers or CVV. Payment processors handle your data under their own privacy policies.

You agree to provide current, complete, and accurate billing information and to promptly update it.

7) Shipping, delivery & risk of loss

Shipping options, costs, and estimated delivery times are shown at checkout and/or on our Shipping page.

Title and risk of loss pass to you upon our delivery to the carrier, unless otherwise required by applicable law.

Delivery dates are estimates and not guaranteed. We are not responsible for delays outside our control.

8) Returns, exchanges & refunds

Our Return Policy (incorporated into these Terms) explains eligible items, timeframes, condition requirements, and processes.

Unless stated otherwise, [example: returns are accepted within 30 days of delivery for unused items in original packaging]. Certain items (e.g., final sale, perishable, intimate, customized) may be non‑returnable.

Refunds are issued to the original payment method after we receive and inspect returned items. Shipping fees, duties, and taxes may be non‑refundable unless required by law.

9) Promotions, coupons & gift cards

Promotions and coupons are subject to specific terms. We may modify or cancel promotions at any time.

Gift cards/store credit are redeemable only on the Site, are not reloadable, non‑refundable, and cannot be exchanged for cash except where required by law. Treat gift cards like cash; lost or stolen cards may not be replaced.

10) Subscriptions & pre‑orders (if offered)

Subscriptions renew automatically at the stated interval until cancelled. You can cancel future renewals at any time before the renewal date.

Pre‑order dates are estimates. We may adjust release/shipping dates; you may cancel prior to shipment for a refund of amounts paid.

11) User content (reviews, comments, uploads)

You may be able to submit reviews, comments, photos, or other content (“User Content”). You retain ownership of your User Content but grant CANBOSENG a worldwide, non‑exclusive, royalty‑free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works from it in connection with the Services and our marketing.

You represent that your User Content is accurate and does not infringe others’ rights or violate laws.

We may moderate, remove, or refuse User Content at our discretion.

12) Acceptable use

You agree not to, and not to attempt to:

Use the Services for illegal, harmful, or fraudulent activities;

Interfere with or disrupt the Services or security features;

Access accounts or data without authorization;

Use scraping, bots, or automated means without our permission;

Upload viruses, malware, or harmful code;

Infringe intellectual property or privacy rights;

Harass, abuse, or harm others;

Misrepresent your identity or affiliation; or

Resell, export, or divert products in violation of laws or our policies.

13) Intellectual property

The Site and its content, including text, graphics, logos, icons, images, software, and trademarks, are owned by CANBOSENG or our licensors and are protected by intellectual‑property laws.

You may not use our trademarks or trade dress without our prior written permission.

14) Third‑party services & links

The Services may link to or integrate third‑party sites and services. We do not control and are not responsible for third‑party content, policies, or practices. Your use of third‑party services is at your own risk and subject to their terms.

15) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share personal information. Please review it carefully.

16) Disclaimer of warranties

To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. Some jurisdictions do not allow limitations on implied warranties, so these limitations may not apply to you.

17) Limitation of liability

To the fullest extent permitted by law, CANBOSENG and our directors, officers, employees, agents, suppliers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of the Services or products, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory—even if we have been advised of the possibility of such damages.

Where liability cannot be excluded, our aggregate liability for all claims relating to the Services or products will not exceed the greater of (a) the amount you paid to CANBOSENG for the product(s) at issue in the 12 months preceding the claim, or (b) CAD $100.

Some jurisdictions do not allow certain exclusions or limitations of liability; in such cases, the above limitations apply to the maximum extent permitted by law.

18) Indemnification

You agree to indemnify, defend, and hold harmless CANBOSENG and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Services, your violation of law, or your infringement of any third‑party right.

19) Governing law & venue (Canada)

These Terms and any disputes are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict‑of‑laws rules. You and CANBOSENG agree to the exclusive jurisdiction of the courts located in Toronto, Ontario, except that either party may also seek injunctive or equitable relief in any court of competent jurisdiction.

If you are a consumer, mandatory consumer protection laws of your province/territory may also apply for your benefit.

20) Termination & suspension

We may suspend or terminate your access to the Services at any time, with or without notice, for any violation of these Terms or if we believe your use may cause harm or legal liability. Upon termination, provisions that by their nature should survive will remain in effect (e.g., intellectual property, disclaimers, limitations of liability, indemnities, and governing law).

21) Changes to the Services & Terms

We may modify the Services and these Terms from time to time. If we make material changes, we will provide notice (e.g., by posting on the Site, updating the Effective date, or sending an email). Your continued use after changes become effective constitutes acceptance of the revised Terms.

22) Electronic communications & consent to do business electronically

By using the Services, you consent to receiving electronic communications from us (e.g., emails, notices on the Site) and to conducting transactions electronically. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

23) Export & sanctions compliance

You represent that you are not located in, under the control of, or a resident/citizen of any country or entity subject to embargoes, sanctions, or similar restrictions. You agree not to export, re‑export, or transfer products in violation of applicable export/sanctions laws.

24) Miscellaneous

Severability: If any provision is unlawful or unenforceable, it will be deemed modified to the minimum extent necessary, and the remaining provisions remain in full force.

No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment: You may not assign or transfer your rights or obligations without our prior written consent. We may assign these Terms in connection with a merger, sale, or restructuring.

Entire agreement: These Terms and the policies referenced herein (including the Privacy Policy and Return Policy) constitute the entire agreement between you and CANBOSENG regarding the Services.
